Federal Court Orders Release of Kilmar Abrego Garcia from ICE Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without legal authority.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The case originates in a erroneous deportation to El Salvador in March, which US authorities later admitted was an mistake. After his repatriation to the United States to answer human smuggling charges, he was detained in federal detention.
In her order, the court pointed out that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
